By placing an order through our online store, you agree to these Terms and Conditions.

1. General Provisions

These Terms and Conditions govern the contractual relationship between the customer (“Customer”) and SIA SewLab (“Seller”) for purchases made through www.pastelbabydesign.com.

Purchases made through the online store constitute distance contracts and are subject to applicable Latvian and European Union consumer protection legislation.

Nothing in these Terms limits any mandatory consumer rights provided by applicable law.

The version of the Terms applicable to an order is the version in force at the time the order is placed.

2. Products and Prices

Product descriptions, available options and prices are displayed on the relevant product pages.

Prices are displayed in the currency shown in the online store. Any applicable shipping charges are displayed during checkout before the Customer completes the purchase.

Product photographs are intended to represent our products as accurately as reasonably possible. However, colours may appear slightly different depending on screen settings, lighting and the characteristics of natural fabrics and materials.

As many of our products are handmade, minor variations in dimensions, stitching, fabric placement or other details may occur and are not necessarily considered defects.

We reserve the right to change prices, product availability, product descriptions and promotions. Such changes do not affect orders that have already been confirmed.

If we are unable to fulfil an order, we will contact the Customer and provide an appropriate solution, including a refund where applicable.

3. Orders and Payment

Orders are placed by selecting products, available options and, where applicable, personalization details, adding them to the cart and completing checkout.

The Customer is responsible for providing accurate contact, personalization and delivery information.

Before submitting an order, the Customer should carefully check all personalization details, including names, initials, colours, sizes and other selected options.

Once payment has been successfully completed and the order confirmed, a sales contract is formed between the Customer and SIA SewLab.

Available payment methods are displayed at checkout and may vary depending on the Customer's location.

Payments are processed securely through the payment providers available in our online store.

4. Personalized and Custom-Made Products

Some of our products can be made according to the Customer's specifications or personalized, including with names, initials or custom embroidery.

The Customer is responsible for ensuring that personalization information submitted with the order is correct.

Products made to the Customer's specifications or clearly personalized are generally excluded from the statutory right of withdrawal where permitted by applicable consumer law.

If you notice an error in your personalization details after placing an order, please contact us as soon as possible at hello@pastelbabydesign.com. We cannot guarantee that changes will be possible once production or personalization has begun.

This exclusion does not affect the Customer's statutory rights where a personalized product is defective, damaged, incorrect or otherwise not in conformity with the contract.

5. Delivery

Available delivery destinations, methods and prices are displayed during checkout.

Estimated processing and delivery times may vary depending on the product, destination, season and selected delivery method.

Delivery estimates are not guaranteed unless expressly stated otherwise.

The Customer is responsible for providing complete and accurate delivery information.

If a parcel is returned to us because of an incorrect or incomplete address, failure to collect the parcel, or another circumstance attributable to the Customer, additional shipping charges may apply if the Customer requests that the order be sent again.

Risk of loss or damage passes to the consumer when the Customer, or a third party designated by the Customer other than the carrier, physically receives the goods, except where applicable law provides otherwise.

6. Returns and Right of Withdrawal

For eligible non-personalized products, we offer a 30-day return period from receipt of the order.

Customers in the European Union also have the statutory right to withdraw from eligible distance contracts within 14 days without giving a reason, subject to the exceptions provided by law.

Where several goods from one order are delivered separately, the statutory withdrawal period is calculated from receipt of the last applicable item.

The statutory right of withdrawal does not apply to goods made to the Customer's specifications or clearly personalized, where this exception applies under consumer law.

Customers can submit an eligible cancellation or return request through the “Cancel or return an order” link available on our website or contact us at hello@pastelbabydesign.com.

Unless otherwise required by law, the Customer bears the direct cost of returning goods when exercising the right of withdrawal.

7. Order Cancellation

Customers may submit a cancellation request for an order that has not yet been fulfilled through the “Cancel or return an order” function available on our website.

For personalized or custom-made products, cancellation may no longer be possible once production or personalization has begun.

Submitting a cancellation request does not automatically guarantee cancellation. We will review the request according to the status of the order and applicable consumer law.

8. Defective, Damaged or Incorrect Goods

Customers have statutory rights in relation to goods that are defective, damaged, incorrectly supplied or otherwise not in conformity with the contract.

If there is a problem with your order, please contact us at hello@pastelbabydesign.com and provide your order information and, where helpful, photographs showing the issue.

We will assess the matter and provide an appropriate remedy in accordance with applicable consumer protection law.

These rights are separate from the right of withdrawal and from our voluntary return policy.

9. Refunds

Refunds are made in accordance with our Return & Refund Policy and applicable consumer law.

Where a Customer validly exercises the statutory EU right of withdrawal, amounts required by law will be reimbursed, including the cost of our least expensive standard delivery option where applicable.

Additional costs resulting from the Customer choosing a more expensive delivery method than our standard delivery option are not refundable where permitted by law.

We may withhold reimbursement until we receive the returned goods or the Customer provides evidence that the goods have been sent back, whichever occurs first, where permitted by applicable law.

Refunds are normally issued using the same payment method used for the original transaction unless otherwise agreed.

10. Privacy and Personal Data

Personal data is processed in accordance with our Privacy Policy and applicable data protection legislation, including the General Data Protection Regulation (GDPR).

We process information necessary to manage orders, payments, delivery, customer service and other legitimate business operations.

Personal data may be shared with service providers where necessary to provide these services, including payment processors and delivery providers.

11. Intellectual Property

Unless otherwise stated, the content of www.pastelbabydesign.com, including photographs, product designs, text, graphics, branding and other original content, is owned by or licensed to SIA SewLab.

Such content may not be reproduced, distributed or used commercially without prior permission, except where permitted by law.

12. Liability

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

The Seller is not responsible for delays or failure to perform obligations caused by circumstances outside its reasonable control, subject to the Customer's mandatory statutory rights.

We will make reasonable efforts to resolve the matter directly with you.

Consumers may also contact the Consumer Rights Protection Centre of Latvia (Patērētāju tiesību aizsardzības centrs – PTAC) or use an applicable out-of-court consumer dispute resolution body.

Nothing in these Terms prevents a consumer from exercising any rights or remedies available under applicable law.

14. Governing Law

These Terms and Conditions are governed by the laws of the Republic of Latvia, without depriving consumers residing in another country of any mandatory protections provided to them under applicable law.
